Tetrahydrocannabiphorol (THC-P) is an incredibly popular derivative of the hemp plant that has changed our very conception of industrial hemp. Present in very minor levels, THC-P naturally occurs in the plant’s flowers, alongside delta 9 THC, CBD, and all of those other well-known cannabinoids. However, we never even knew THC-P existed until 2019, when it was discovered using the most up-to-date analysis techniques to better understand the plant’s fascinating chemical makeup.
Basically, tetrahydrocannabiphorol is considered to be the most intoxicating cannabinoid in the entire cannabis genus. Keep in mind though, we’re still learning about it, but so far, it appears that it attaches to the same cannabinoid receptors in the brain linked to the high we get from delta 9 THC, but at about 31x the rate. This is why THC-P is believed to be 10x as intoxicating as delta 9, which means that you can get outrageously high off of it.
All that considered though, we have to mention that tetrahydrocannabinol comes with some tricky aspects to its legality, when you look at state laws. Hemp laws have changed a lot from one state to the next, so we would like to provide the most up-to-date list of where THC-P is and isn’t legal.
Disclaimer: This blog article is intended to offer general knowledge to the average hemp consumer. It is not a replacement for legal advice, nor should it be used as a legal guide for local businesses that carry THC-P products. Keep in mind that while this features the most up-to-date information as of July 2024, THC-P laws may have changed in your state by the time of reading this article. Please stay up to date with your local laws to always be in the know!
THC-P According to Federal Law

Before we dive into each state’s THC-P laws, let’s talk about federal law. THC-P is, in fact, totally legal as a result of the Farm Bill in 2018. That year, U.S. legislators voted to approve the legalization of the industrial hemp plant and all of its derivatives, with one caveat: that hemp products may not contain more than 0.3% delta 9 THC.
Once the Farm Bill legalized industrial hemp, this led to the development of a new legal framework that would determine regulations and restrictions regarding how industrial hemp may be cultivated, and how products may be processed, packaged, marketed, sold, and purchased. At the time of the passing of the Farm Bill, it’s unlikely that legislators foresaw the discovery of non-delta 9 THC cannabinoids that have psychoactive properties, and that they would become so popular on the market.
With that being said, THC-P is a federally protected derivative of the hemp plant, as THC-P is not the same as delta 9 THC, and it is therefore not held to any restrictions.

Frequently Asked Questions Regarding the Legal Status of THC-P
Now that we’ve covered the state-by-state legal status of tetrahydrocannabiphorol, let’s answer some frequently asked questions that are related to the information above.
Can THC-P Cause Me to Fail a Drug Test?
It’s actually very likely that taking THC-P will cause a failed drug test result. When THC-P is metabolized in the body, it converts into THC-COOH, and delta 9 THC, the leading compound in marijuana, converts into the same metabolite. Drug tests are looking for THC-COOH, so THC-P can trigger a positive result.
Can I Legally Drive Under the Influence of THC-P?
Even if THC-P is legal where you live, driving under the influence of an intoxicant is strictly illegal, and this may get you into trouble with the law.
Can THC-P Flower Get Confused with Marijuana by a Law Enforcement Official?
THC-P flower – that is, hemp flower infused with THC-P, which may be legal in your state – can be confused with marijuana flower, because it looks and smells identical. This means that a law enforcement official may mistakenly think that you have weed in your possession, unless they are willing to test it for marijuana.
How Can I Check Current Laws Regarding THC-P’s Legality in My State?
It can be tricky to stay up to date on local laws regarding cannabis products like THC-P. Our best recommendation is to type the name of the cannabinoid into your search engine bar, along with the name of your state. This should show you if there any any laws in the woodwork regarding the legal status of certain hemp derivatives.
Final Thoughts
At the end of the day, THC-P’s legal status is going to vary dramatically from one state to the next. For the time-being, a little more than half of the states in the US permit sales of THC-P without any notable restrictions, and that’s good news.
